AGREEMENT between All eBiz, hereinafter called the Provider, and the Client being the user of the Provider's services .

TERM of this agreement shall commence upon the submission of the order by the Client, and terminate on one calendar months written notice by either party

SERVICES provided to Client by Provider shall consist of an Internet showcase site for Client to list products/services with pictures and/or descriptions of same. Client shall have access to the software to administer/change/update Client's own web site and the information thereon, and Client shall be responsible for the content on Client's specific site.

All pornographic materials are prohibited from being placed on Client's web site and shall be sufficient reason for Provider to terminate Client's website without refund. Client is prohibited from engaging in any unlawful act(s) or business and there will be no refunds given to Client should such termination occur.

Client will furnish their own computer and accessories necessary to access the Internet and make changes to Client's own site and showcase information to be uploaded, edited or deleted; including personal ISP and email connections.

Provider will furnish Client with 5mb of space for Client's personal website. Client will be notified of any excess space usage and will be required to immediately reduce the size of Client's website OR make written agreements with Provider for additional space and pay Provider for said additional space at Provider's standard rates . Failure to meet this requirement on Client's part shall result in termination of this agreement without refund.

GOVERNING LAW - This agreement shall be construed in accordance with and governed by the laws of the Republic of South Africa , irrespective of the fact that a party hereto may not be a resident of or maintain a place of business in that country.

INDEMNIFICATION/HOLD HARMLESS - Client shall hold Provider harmless in and from all claims, liabilities, damages, and detriments not arising from Providerís actual negligence or malfeasance. Client irrevocably covenants, promises and agrees to hold Provider harmless from and against any and all losses, claims, expenses, suits, damages, costs, demands or liabilities, joint or several, of whatever kind or nature that Client may experience as a result of loss of service/access to said website provided by Provider resulting from causes beyond the control of Provider: including, but not limited to: acts of God or Nature, fires, strikes, floods, riots, power outages, telecommunication outages, ISP downtime and/or offline time, interfering requirements or regulations of the Republic of South Africa, Provinces or local governments or any other civil or military authority. Delays or non-performance excused by this provision shall not excuse payment of any amount due hereunder owed at the time of the occurrence.
